Before purchasing any products on the website www.onday.fr (hereinafter " the Site "), we thank you for reading the advice for use and the precautions for use relating to each product.
Warning
The use of the products offered on onday.fr assumes an appropriate lifestyle. These products are not medicines and can in no case be used as substitutes for a varied and balanced diet and a healthy lifestyle.
If you are pregnant, following medical treatment, or in the event of a particular nutritional or dietary regime, pathology, allergy, food intolerance, or health problem of any kind, or in the event of doubt about your state of health, we recommend that you first consult a health professional.
We do not guarantee any obligation of result regarding the effects of the products for the customer. Each individual is unique, and the effects of the products can vary depending on many personal factors.
By placing an order on the Site, you unreservedly accept these general terms and conditions of sale (GTC).
These general terms and conditions of sale (hereinafter " GTC" ) are concluded between, on the one hand, onday, a company registered with the RCS of Paris under number 92816101700019, whose head office is located at 10, Passage Lathuille, 75018, PARIS, hereinafter referred to as " We " or " the Seller ", and, on the other hand, any natural or legal person wishing to make a purchase via the website onday.fr, hereinafter referred to as " You " or "the Customer ".
By placing an order on the Site, you unreservedly accept these General Terms and Conditions.
The Website is hosted by Shopify International Limited, a private company limited by shares, incorporated in Ireland under registration number 560279, whose registered office is located at 2nd Floor Victoria Buildings, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (VAT number IE 3347697KH) and whose general terms and conditions of sale are: https://www.shopify.fr/legal/conditions
1. Purpose
These General Terms and Conditions aim to define the terms of distance selling between the Seller and the Customer, in particular concerning the order, payment, delivery and the right of withdrawal.
2. Products
The products offered for sale on the Site are food supplements in powder form, made from vitamins, minerals, plants, probiotics, antioxidants and amino acids. Each product is accompanied by a detailed description (composition, indications, conditions of use, etc.).
We are committed to providing products that comply with current legislation and standards applicable in France and the European Union.
3. Order
3.1. Creation of a Customer Account:
To place an order, it is necessary to create a customer account. You must provide accurate and complete information and keep this information up to date.
3.2. Placing an Order:
The order is placed directly on the Site. After selecting the products, you can check the contents of your basket, the total amount of the order and correct any errors before definitively validating your order.
3.3. Order Confirmation:
The order is confirmed once payment has been made. We will send you a confirmation email summarizing the details of your order.
4. Price and Payment
4.1. Price:
Product prices are indicated in euros (€), all taxes included (TTC). Delivery costs are calculated in addition and are displayed before the order is validated.
4.2. Modification of Prices:
We reserve the right to change our prices at any time. However, products will be billed based on the rates in effect at the time the order is validated.
4.3. Payment Terms:
Payment is made online via a credit card (Visa, MasterCard, American Express), PayPal, or any other secure payment method offered on the Site. The card is debited at the time of order validation.
4.4. Payment Security:
Online payment is secured by encryption protocols that comply with current standards (SSL). Payment information is never communicated to the Seller.
5. Delivery
5.1. Delivery Areas:
We deliver to mainland France and some countries in the European Union. For any delivery requests outside these areas, please contact us.
5.2. Delivery Times:
Delivery times are indicated on the Site at the time the order is placed by the Customer and may vary depending on the availability of stocks of the Product ordered or the delivery method selected by the Customer.
Delivery times are in working days (Monday to Friday – excluding public holidays or bank holidays) and correspond to the average times for preparing and delivering an order.
The delivery period starts from the date of confirmation of the order by the Company.
5.3. Delivery Problems:
The risks on the Products are transferred to the Customer upon receipt of the Product(s) ordered. The Customer is required to check the condition of the packaging and the Products delivered upon receipt.
It is up to the Customer to issue any reservations and complaints that he deems necessary, or even to refuse the package if it is damaged upon delivery.
In the event of non-conformity, loss or damage to the Product(s) ordered due to transport, the Customer undertakes to inform the Company as soon as possible by email at help@onday.fr for an investigation with the carrier.
The Company cannot be held responsible for any failure or delay in delivery which would be due to the Customer (for example, incomplete or inaccurate delivery information communicated at the time of the Order, preventing delivery from being made as planned) or to a case of force majeure.
6. Right of Withdrawal
6.1. Conditions for Exercising the Right of Withdrawal:
In accordance with Articles L.221-18 et seq. of the Consumer Code, you have 14 days from receipt of the products to exercise your right of withdrawal without having to provide reasons or pay penalties.
6.2. Return Terms:
To exercise your right of withdrawal, you must inform us of your decision by email at help@onday.fr . The products must be returned in their original packaging, unopened and in perfect condition to the following address: SAS onday, 10 Passage Lathuille, 75018 PARIS. The return costs are your responsibility.
6.3. Reimbursement:
Reimbursement is made within 14 days of receipt of the returned products.
7. Guarantees
7.1. Legal Guarantee of Conformity:
Our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, in accordance with articles L.217-4 et seq. of the Consumer Code and articles 1641 et seq. of the Civil Code.
7.2. Warranty Conditions:
In the event of a defective or non-compliant product, you can return the product to us, specifying the defect found. We will exchange or refund the product, subject to compliance with legal conditions.
8. Liability
We decline all responsibility for indirect damages or damages resulting from improper use of the products. We cannot be held responsible for non-compliance with the legislation of the country where the products are delivered.
The Customer must be over 18 years old and have the legal capacity to contract.
In case of doubt as to the Client's majority, the Company reserves the right to immediately suspend the Client's Account without notice.
9. Personal Data
We collect and process your personal data in accordance with our Privacy Policy, available on the Site.
10. Intellectual Property
All elements of the Site (texts, images, graphics, logo) are the exclusive property of onday or its partners. Any reproduction, representation or exploitation, in whole or in part, of these elements is strictly prohibited without prior written authorization.
11. Modification of the T&Cs
We reserve the right to modify these T&Cs at any time. The new T&Cs will be applicable to orders placed after they are posted on the Site.
12. Applicable Law and Disputes
These General Terms and Conditions are subject to French law. In the event of a dispute, the Customer agrees to contact customer service to try to find an amicable solution. Failing this, the dispute will be submitted to the competent courts of Paris.
